Georgia Law Regarding Firearms Possession for Felons

Possession of firearms by a convicted felon is described under Title 16, Section 16-11-131 of Georgia law. The law states that anyone who is on probation as a felony first offender or anyone who has been convicted of a felony by a court in the U.S. or in a foreign nation who receives, possesses, or transports a firearm is guilty of a felony. The penalty for a conviction of this offense is a prison term of one to five years.

If the previous felony conviction was a forcible felony, the penalty given is the maximum under the law. A forcible felony is one in which threat of force or use of force or violence against another person occurred. Forcible felonies occur in such crimes as murder, burglary, robbery, kidnapping, and similar offenses. Those with previous forcible felony convictions who attempt to purchase or transfer a firearm will be charged with this new crime as a felony punishable by five years in prison.
